Affidavit-of-service filed on behalf of the petitioners is taken on record.

Matter is heard in presence of the learned advocates representing the petitioners, State respondents and Election Commission of India. 3.

A teachers' organization, namely, All Bengal SLSTFreshers Organisation (for short 'Organisation') has made an application on 27th March, 2026 to the Officer-in-Charge, Bidhannagar North Police Station, Bidhannagar Police Commissionerate seeking permission to convene a sit-in demonstration for three consecutive dates i.e. from 11th April, 2026 to 13th April, 2026.

It is also indicated in the said application that demonstration would be organized at Central Park, near Karunamoyee crossing at Salt Lake. Number of participants as per application will be three hundred (300).

Mr. Dasgupta, learned advocate representing said Organisation has submitted that in spite of submitting such application before the concerned police authority on 27th March, 2026 till date there is no response.

Petitioners pray for direction upon the concerned police authorities which would permit the said Organisation to convene sit-in demonstration on the particular dates as stated in the application dated 27th March, 2026.

Mr. Sen, learned Additional Advocate General appears on behalf of the State respondents and has placed before this Court two communications dated 10th April, 2026 of Inspector-in-Charge, Bidhannagar North Police Station, Bidhannagar Police Commissionerate and another also dated 10th April, 2026 of Inspector-in-Charge, Bidhannagar East Police Station, Bidhannagar Police Commissionerate which are taken on record. 8.

It is submitted on behalf of the State respondents placing reliance upon these two communications dated 10th April, 2026 that in view of ongoing Assembly Election preparedness and several offices situate in and around Karunamoyee, Salt Lake, office goers as well as commuters would find it difficult to attend their places of work.

It is also submitted that due to ensuing Assembly Election police personnel are deployed at several

places to maintain law and order as a result whereof police authorities would also find it difficult to regulate the programme by deploying requisite number of police personnel on particular dates when such sit-in demonstration would be convened .

Having considered the submissions made on behalf of the parties and taking note of the provisions contained under Article 19(1)(b) of the Constitution of India vis-à-vis reasonable restrictions, said Organisation shall be permitted to convene sit-in demonstration on 11th April, 2026 and 12th April, 2026 at Central Park, Salt Lake for a period of three hours which will commence from 1 PM and end at 4 PM. Number of participants at a time will be not more than three hundred (300).

11. Concerned police authorities are directed to deploy adequate number of police personnel to maintain law and order and further to see that no untoward incident takes place.

12. However, participants in the sit-in demonstration shall adhere to sound norms.

13. The petitioner Organisation shall send names of five members of the said Organisation and their particulars and mobile numbers to the Inspectorin-Charge, Bidhannagar North Police Station, Bidhannagar Police Commissionerate by 8 PM today.

14. Those volunteers shall be responsible to regulate the programme on aforesaid two dates.

15. With the aforesaid directions and observations, writ petition stands disposed of.

16. Learned advocates representing the said Organisation and State respondents are directed to communicate this order immediately to the concerned police authorities without waiting for server copy of this order.
