In re: CAN 2 of 2024 The CAN 2 of 2024 has been filed, inter alia, stating that FMA 379 of 2023 had been disposed of on 8th February, 2023 by this Court in favour of the claimants/respondents, namely, Smt. Monimala Ghosal, Basanti Ghosal and Ahana Ghosal being the wife, mother and daughter of the deceased respectively. The mother of the deceased, namely, Basanti Ghosal expired on 9th February, 2024 succeeded by her daughter Anindita Banerjee.

The petitioners prayed for substitution of Anindita Banerjee in place of Basanti Ghosal since deceased. The department is directed to delete the name of Basanti Ghosal from the memorandum of appeal and add the name of Anindita Banerjee as one of the legal heirs of Basanti Ghosal since deceased.

It has been further affirmed that Basanti Ghosal is survived by the aforesaid Anindita Banerjee and Ahana Ghosal.

Ahana Ghosal is already one of the claimants/respondents.

The claim amount pertaining to the deceased Basanti Ghosal shall devolve equally upon the substituted Anindita Banerjee as well as Ahana Ghosal.

Accordingly, the CAN 2 of 2024 is disposed of. (Ananya Bandyopadhyay, J.)
