Archana Ghosh Mr. Mit Guha Roy ...for the petitioner This is an application under Article 227 of the Constitution of India at the instance of the plaintiff praying for a direction upon the learned Civil Judge (Junior Division),5th Court at Alipore to dispose of Misc. Case No.100 of 2021 filed under Order IX Rule 9 of the Code of Civil Procedure, 1908 expeditiously.

In view of the order sought and proposed to be passed, there is no necessity to direct service of notice upon the opposite party. However, the petitioner shall be obliged to serve a copy of the instant revisional application along with this order upon the opposite party as well as the learned advocate representing the opposite party before the learned trial judge.

From the order sheet appended herein, this court finds that the argument of the petitioner in the miscellaneous case has been completed and that May 3, 2025 has been fixed for argument by the opposite party. In view of the fact that the miscellaneous case has been fixed for argument by the opposite parties, CO No.1301 of 2025 is disposed of requesting the learned Civil Judge (Junior Division), 5th Court at Alipore to take up the miscellaneous case on the next date fixed for hearing i.e. on May 3, 2025, and dispose of the same expeditiously

preferably by the end of July 2025, without granting unnecessary adjournment to either of the parties. Certified copy of this order, if applied for, shall be made available to the parties.
