Mr. Amitava Mitra Ms. Antara Choudhury .... For the Respondent. At the instance of the respondent, this appeal has been placed in the list as 'To Be Mentioned'. The appeal was from an ad-interim order dated 6th January, 2009 passed by the learned city civil court in the suit (Title Suit No. 46 of 2009).

It was admitted by this court after condoning the delay on 5th May, 2009.

Learned counsel for the respondent hands up to this court an information slip of the learned city civil court which states that on 14th June, 2010 the suit had been 'disposed of'. The information slip is taken on record. Inspite of this on 28th February, 2011 directions were obtained from this court for filing of informal paper books.

In those circumstances, any subsisting interim order has merged with the decree. Hence, as rightly stated by learned counsel for the respondent, nothing remains in this appeal.

We dismiss the same.

Interim order, if any, is vacated.
