17.06.2022 Item No.6 BR WPA 8087 of 2022 Sri Subhendu Mukherjee & Ors.
Vs.
The University of Calcutta & Ors.
(Via Video Conference) An application under Article 226 of the Constitution of India Mr. Ashit Kumar Chakraborty, Mr. Krishnendu Bera, Ms. Debolina Chakraborty ...... For the petitioners Mr. Nilotpal Chatterjee, Mr. Satyaki Banerjee ....... For the Calcutta University By filing this writ petition the petitioners seek restoration of their seniority following a report of the Grievance and Redressal Cell of the Calcutta University. The report is annexed as R-1 to the affidavit filed by the University. The petitioners submit that such report was accepted and approved by the Syndicate of the University by a resolution dated December 8, 2021. It is the further case of the petitioners that the report of the Grievance and Redressal Cell was also approved by the Vice Chancellor for restoration of seniority of the petitioners. Mr.
Nilotpal Chatterjee, learned advocate representing the Calcutta University submits that the report filed by the Grievance Committee and Redressal Cell was not conclusive; no final decision has yet been
taken. The report was submitted before the Vice Chancellor with some observations only.
In view of the stand taken by the University, I dispose of this writ petition giving direction upon the Registrar, Calcutta University, respondent no.4 in this petition, to ensure that the Grievance and Redressal Cell comes to a final finding with regard to the seniority position of the petitioners within a period of three months from the date of communication of this order and immediately thereafter places its report before the ViceChancellor for further steps. Since no affidavit has been invited, the allegations made in the writ petition are deemed to be denied by the University.
WPA No.8087 of 2022 is, accordingly, disposed of. Parties are directed to act on the server copy of this order.
