Petitioner is aggrieved by the fact that in spite of informing the Inspector-in-charge, Mandir Bazar Police Station no steps have been taken by the concerned police station. The main allegation of the petitioner is preparation of forged and fake documents so far as the title deed of the property is concerned. In spite of cognizable offence having been made out, the police authorities did not register the case and as such the petitioner has been compelled to approach this court.
Learned advocate for the State has submitted a report. Report reflects that the police authorities have considered the contentions but no documents were submitted, as such the police authorities could not register any case.
In view of the submissions of both the parties, I am of the opinion that the petitioner under the changed circumstances should approach the learned Magistrate if so advised under the relevant provisions of law. Learned Magistrate would assess regarding the accusations so made and as to whether a case for investigation is made out and accordingly, as he deems fit and proper would either pass necessary orders or refuse the same.
With the aforesaid observations WPA 8478 of 2025 is disposed of.
Report so submitted be kept with the record.
Copy of the report be handed over to the learned advocate appearing for the petitioner. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
