This is an application under Article 226 of the Constitution of India wherein the writ petitioner is aggrieved by the inaction on the part of the respondent authorities in considering her application for transfer under West Bengal School Service Commission (General Transfer, Transfer on Special Ground and Reallocation) Rules, 2015.
From perusal of the writ petition it is evident that the application has been made in the form prescribed and the 'no objection' certificate has been given by the school authorities which is annexed at page 42 of the writ petition.
Subsequently, the petitioner made an application before the Commissioner of School Education by way of a letter dated 9th December, 2020.
In light of the factual matrix, I direct the Commissioner of School Education to consider the
application of the petitioner and also consider the annexures made in the writ petition and thereafter pass a reasoned order within a period of eight weeks from date. The reasoned order is to be communicated to the petitioner within two weeks thereafter.
Since no affidavit-in-opposition is called for, allegations made in the writ petition are deemed not to have been admitted.
With the above directions, this writ petition is disposed of.
