Criminal Revisional Jurisdiction 18-07-2022 Subha Item no.53 Ct no.34 CRR 984 of 2010 Dr. Subir Dey -versus- Smt. Itirekha Dey Ms. Sreyashee Biswas ...for the petitioner.

Ms. Biswas, learned advocate appearing for the petitioner submits that the learned trial court directed the petitioner to pay maintenance of Rs.2000/- per month to the wife/opposite party with effect from 1st February, 2010 in connection with Misc. Case No. 152 of 2006. The said order was challenged before this court and on 5th April, 2010, a Co-ordinate Bench of Court was pleased to direct the petitioner to pay a sum of Rs.1500/- per month. Learned advocate for the petitioner further submits that such amount of Rs.1500/- per month is till date paid regularly. In view of the aforesaid, the amount of Rs.1500/- per month modified by this court is made absolute.

If there are change of circumstances, the petitioner would be at liberty to approach the trial court under Section 127 of the Code of Criminal Procedure. Accordingly, I directed the order of the learned Magistrate is modified to the limited extent as stated above. With the aforesaid observations, the present revisional application being CRR 984 of 2010 is partly allowed.
