Petitioner is aggrieved that the private respondents are trying to encroach upon their land and as such he is unable to cultivate his own land. On the other hand learned advocate for the private respondents submits that the petitioners have sold out a portion of their land and trying to encroach their land.

Learned advocate for the state submits that the dispute between the petitioner and the private respondents are absolutely civil dispute and police authorities have no role to play.

Petitioner has complained with the Superintendent of Police, Purba Bardhaman with copy to Officer-in-Charge, Shaktigarh Police Station. I find that the main thrust was on the order of section 144 Cr.P.C. passed by the learned Executive Magistrate which by efflux of time has lost its force.

Petitioner and the opposite parties are at loggerhead.

Accordingly the Officer-in-Charge of Shaktigarh Police Station will ensure that no breach of the peace takes place over the issue of cultivation which both the parties presently are adamant to encroach upon.

With the aforesaid observations WPA 9209 of 2024 is disposed of.
