The grievance raised in the writ petition is that the CESC Limited has refused to give a new electricity connection to the petitioner, despite the petitioner having applied for the same, on several grounds, primarily on the ground of apprehended splitting of consumption of units.

It is seen from the written communication of the CESC Limited dated February 2, 2023, annexed to the present writ petition, that apart from the splitting of load, the Licensee has also cited risk of fire and electrical hazards if another electricity connection given to the same premises. Learned counsel appearing for the CESC Limited submits that the petitioner has applied for

a second commercial connection in respect of the same premises.

To this, learned counsel for the petitioner submits that the petitioner is not a consumer in respect of the existing commercial connection at the premises.

Be that as it may, in view of the nature of the objection taken by the CESC Limited, this is a fit case to be decided as per law by the concerned Grievance Redressal Officer (GRO).

Accordingly, WPA No. 8503 of 2023 is disposed of by granting liberty to the petitioner to approach the concerned GRO with the dispute as raised in the present writ petition.

If so approached, the GRO shall decide the same in accordance with law upon giving opportunity of hearing to all concerned as expeditiously as possible, preferably within eight weeks from the date of such reference being made.

There will be no order as to costs.

Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
