Matter relates to transfer of the petitioner, who is a teacher working in a primary school in Malda. An offline application for transfer was made on 16th August, 2023 and same is pending consideration. It is submitted that petitioner is finding difficulty to attend her place of work due to the distance in between the present school of the petitioner and her place of residence. State respondents and Chairman, District Primary School Council, Malda being respondent no.5 are represented by learned advocates.

Having considered the submissions made on behalf of the parties, writ petition stands disposed of directing respondent no.5 to decide transfer application of the petitioner dated 16th August, 2023, which is at page 34 of the writ petition by six (6) weeks from the date of communication of this order. The decision to be taken

by respondent no.5 shall be communicated to the petitioner by ten (10) days thereafter.

It is made clear that suspension of portal shall not be a ground to reject transfer application of the petitioner.

However, there shall be no order as to costs. Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
