The petitioner alleges that the bill raised by it upon completion of the work in terms of the work order issued by the Hura Panchayat Samity has not been disbursed till date.
The petitioner filed representation before the Executive Officer, Hura Panchayat Samit on July 21, 2020 and alleges that the same has not been taken up for consideration till date.
None appears on behalf of the respondents despite service.
Affidavit-of-service filed in Court today is taken on record.
As it appears that the representation filed by the petitioner relating to non-payment of the bill is yet to be disposed of by the Executive Officer of the Hura Panchayat Samity, accordingly, the instant writ petition is disposed of by directing the respondent no. 2 to take a decision with regard to the representation filed by the petitioner strictly in accordance with law, at the earliest,
but positively within a period of eight weeks from the date of communication of a copy of this order. The said respondent shall pass a reasoned order and communicate the same to the petitioner immediately thereafter.
It is made clear that this Court has not entered into the merits of the claim of the petitioner and all points are left open to be decided by the said respondent at the time of consideration of the representation of the petitioner.
The petitioner is directed to forward a copy of the representation dated July 21, 2020 along with the bills and other necessary documents to the aforesaid respondent at the time of communicating the order of the Court.
The writ petition stands disposed of.
