Petitioners claim to be the owners of the property and in spite of the same the private respondent nos. 7 to 13 are disturbing the peaceful cultivation, harvesting of paddy and in spite of informing the police authorities no steps have been taken by them, although the record of rights are in favour of the petitioner.

As none appears on behalf of the State Ms.

Sinthia Bala, learned advocate who is empanelled with the Office of the Government Pleader, High Court, Calcutta is directed to represent the State. Her appearance may be regularized by the concerned authorities.

Petitioners made a specific prayer before the Officer-in-charge, Contai Police Station informing the interference of the private respondent nos. 7 to

13. However, the police authorities failed to render

appropriate assistance. Petitioner has referred to the order passed by the Division Bench in W.P.L.R.T. 136 of 2012.

Having considered that the issue presently relates to cultivation and harvesting of paddy, police authorities would ensure that there is no breach of peace and/or tranquility and/or any untoward incident resulting from the nature of the dispute complained of as a strained relationship is existing between the petitioner and the respondent nos. 7 to 13.

With the aforesaid observations WPA 8505 of 2023 is disposed of.
