Mr. Bidyut Kumar Halder Mr. Indranil Halder ...for the petitioner Mr. Debanjan Mukherjee ...for CESC Limited During the pendency of this writ petition, a final order of assessment has been passed, directing the petitioner to pay a sum of Rs. 1,09,626 (Rupees one lakh nine thousand six hundred and twenty-six only). Today, learned advocate appearing for the petitioner has submitted documents disclosing the applicable tariff rate in support of the final order of assessment.
Learned counsel further submits that the petitioner is inclined to prefer a statutory appeal against the said order of assessment. Simultaneously, a prayer has been made for restoration of the petitioner's electricity connection.
It is noted that the final order of assessment was passed by the Assessment Officer on May 5, 2025, during the pendency of this writ petition. In view of the above, liberty is granted to the petitioner to prefer an appeal against the final order of
assessment within a period of 30 days from the date of this order.
The petitioner shall also be at liberty to deposit 50% of the finally assessed amount, without prejudice to the rights and contentions of the parties, along with the applicable incidental charges for reconnection. Upon such deposit, the CESC shall forthwith restore the petitioner's electricity connection.
The appellate authority shall consider and decide the appeal filed by the petitioner as expeditiously as possible.
The remaining balance, if any, shall be paid by the petitioner in accordance with the order to be passed by the appellate authority.
It is also clarified that the petitioner shall continue to pay the current electricity bills regularly. Accordingly, WPA 8443 of 2025 is disposed of. Urgent certified website copy of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
