None appears for the appellant at the time of call.

Learned counsel appearing for the State submits that in all probability, the appellant will not be interested in moving the appeal, since an appeal under Section 10(4) of the West Bengal Highways Act, 1964 has already been preferred by the appellant with a similar grievance.

The written instructions and documents filed by learned counsel for the State today in that regard be kept on record.

Be that as it may, we find from the order sheet that none had appeared for the appellant at the time of call on December 22, 2025 and thereafter on February 5, 2026, whereupon we had recorded

that in the event the appellant was not represented on the next occasion, ex parte orders might be passed in the absence of the appellant. 5.

In such view of the matter, due to the consistent absence of the appellant at the time of call, FMA 742 of 2025 along with CAN 1 of 2025 are dismissed for default without any order as to costs.
