The State of West Bengal Mr. Atarul Haque Molla Mr. Ali Ahsan Alamgir Ms. Riya Das Ms. Rabia Khatoon ...for the petitioner Mr. Prasun Kumar Dutta, Mr. Subrato Roy ...for the State On the basis of an order dated 6th May, 2022 the Investigating Officer has submitted a report regarding authenticity of voter's identity card of the petitioner. It is found from the report that the name of the petitioner was appearing in the voter list of Rudrapur Kichha Assembly Constituency, Uttarakhand. However, his name was subsequently struck down. At present he and his wife are residing with his son-in-law at Thakurnagar Transit Camp Ward No.10 Rudrapur in Uttarakhand.
Therefore, prima facie I find that the voter card of the petitioner is not genuine. His name was struck off from the electoral roll.
Considering all such circumstances, I am not inclined to release the petitioner on bail at this stage.
The prayer for bail is, thus, rejected.
The report be kept with the record.
The application is, thus, disposed of.
