Mr. Bansi Badan Maity ..for the petitioner Mr. Bipin Ghosh ...for the State Affidavit of service filed by the petitioner is taken on record.

None appears for the State despite service.

Mr. Bipin Ghosh, learned advocate, who usually appears on behalf of the State and is present in Court today, is requested to represent the State in this matter. The concerned authority is requested to regularise his appointment in this matter.

The petitioner is directed to serve a copy of this application along with annexure thereto upon Mr. Ghosh in course of this day.

Heard learned counsels for the parties.

The petitioner was appointed as the Job Assistant (G.P.) of Saltora Gram Panchayat and superannuated on September 30, 2019. Despite completing all pension related formalities within due time the pension payment order was issued by the concerned authority on August 24, 2020. Subsequently there was a revision of the pension and gratuity amount payable to the petitioner under the

ROPA Rules, 2019 and revised pension payment order was issued on March 09,2022. The revised gratuity amount was disbursed in favour of the petitioner on April 01, 2022. The petitioner claims interest on delayed payment of the revised gratuity and arrear pension amount. Upon consideration of the submission made on behalf of the parties and material on record, the Director of Pension, Provident Fund and Group Insurance, Government of West Bengal and the Treasury Officer, Bankura, being the 3rd and 4th respondent herein, are directed to pay interest to the petitioner @8% per annum on the revised gratuity and arrear pension amount calculated from January 01, 2020 till the date of actual payment of the amount. Such payment be made within two months from the date of communication of this order. With the above observations and directions this writ petition is disposed of.

There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted.
