In compliance with the direction of this Court, Dr. Patra, learned Counsel for the West Bengal Central School Service Commission files a report and in terms of the leave granted by this Court on February 21, 2024, Ms. Bhattachryya, learned Counsel for the West Bengal Board of Secondary Education files a report affirmed by the Secretary of the Board, let those reports be kept with the record.

The reports suggest that there was no irregularity in the compassionate appointment of candidates though made without the approval of the Education Department as required in terms of the letter of the said department bearing Memo No.981-SE/S/1A03/17 dated October 03, 2018.

The petitioner has already got the compassionate appointment as prayed for as such there is no necessity of keeping the writ petition pending.

Accordingly, WPA 8732 of 2023 is disposed of without any order as to costs.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
