of 2023, refused the present petitioner/appellant to deposit the 20% of the compensation amount as, earlier, the same was rejected by a Co-ordinate Bench of the same court on 18.10.2023.

In view of the appeal pending, I direct that the petitioner would deposit 25% of the compensation amount with the ld. Metropolitan Magistrate, 14th Court, Calcutta within a fortnight from date.

The ld. Magistrate and the ld. Appellate Court is directed, in case, any harsher process of law has been issued because of non-existence of any interim order, the same may be recalled immediately after the deposit of 25% of the compensation amount is made. The ld. Appellate

Court will continue the hearing of the appeal in the mode and manner as it deems fit and proper.

With the aforesaid observations, CRR 1358 of 2024 is disposed of.
