The order dated 16th October, 2025 passed by the Works Manager, Central Workshop, Calcutta State Transport Corporation rejecting the petitioner's prayer for grant of pension by passing a single line order has been impugned in the instant writ petition. 2.

The order of rejection mentions as follows:- "Your prayer dated 21.07.2025 received by this office has been rejected by the Competent Authority."

It has been submitted that the impugned order is bereft of any reason and hence no effect ought to be given to the same.

Learned senior advocate representing the Calcutta State Transport Corporation relies upon the instruction forwarded by the Law Superintendant signed on 19th May, 2026 wherein it has been

mentioned that the petitioner has been paid a sum of Rs.12,95,640/- on account of gratuity under the Payment of Gratuity Act, 1972 on 2nd January, 2026. The fact of receipt of gratuity has not been disclosed by the petitioner in the instant writ petition. It has been submitted that the writ petition is liable to be dismissed on the ground of suppression of material fact. 5.

Upon hearing the parties and on perusal of the documents on record it appears that, admittedly, the impugned order is a one line order without any reason. The petitioner ought to have been intimated the reason for rejection of his prayer for grant of pension. The impugned order cannot be upheld in the eye of law. 6.

In view of the above, the impugned order dated 16th October, 2025 stands set aside.

The Managing Director, Calcutta State Transport Corporation, is directed to reconsider the representation of the petitioner dated 21st July, 2025 for grant of pension under Calcutta State Transport Corporation Employees'

(Death-cum-Retirement Benefits) Regulations, 1990, annexed at page 19 of the writ petition, strictly in accordance with the prevailing Rules at the earliest but positively within a period of six weeks from the date of communication of this order. 8.

A reasoned order shall be passed and communicated to the petitioner.

If the prayer of the petitioner is allowed, then necessary consequential steps shall be taken without any further delay.

The writ petition stands disposed of.

All parties shall act on the basis of a server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
