Mr. Pravas Bhattacharya and Mr. Pratick Bose, learned advocates appearing for the opposite party no.1/State. Their appointment may be regularized by the concerned authority. Heard learned advocate for the State. It is submitted that since condition has not been complied by the petitioner, the revisional application has no force and the same is liable to be dismissed. The matter is listed today for hearing. It appears that this revisional application under Section 401/482 of the Code of Criminal Procedure has been filed by the petitioner, Partha Sarathi Roy assailing order dated 25.03.2011 passed by Learned Judicial Magistrate, Ghatal whereby warrant of arrest was issued against the petitioner in Misc. Execution Case No.14 of 2010, arising out of
Misc. Case No.62 of 2009 under Section 125 of the Code of Criminal Procedure. By order dated 28.07.2011 a conditional stay was granted regarding further proceeding and warrant of arrest issued against the petitioner subject to depositing Rs.10,000/- to opposite party no.2 within ten days from the date of order. No compliance report has been submitted by the petitioner till date. Accordingly, there is no interim order of stay regarding proceeding in connection with Misc. Execution Case No.14 of 2010 arising out of Misc. Case No.62 of 2009.
The revisional application calls for no further order and the same is dismissed for default.
