Mr. Binay Panda and Ms. Puspita Saha, learned advocates who usually appear for the State are present and found representing the State. The appointment of learned advocates may be regularized by the concerned authority in this matter. This criminal revisional application has been filed for quashing of proceeding in G.R. Case No.3735 of 2010 pending before Learned Chief Metropolitan Magistrate, Calcutta arising out of Bowbazar Police Station Case No.645 of 2010 dated 08.10.2010 under Sections 420/ 120B of the Indian Penal Code read with Section 103/104 of the Trade Marks Act. Petitioner was directed to serve notice alongwith copy of the application upon the opposite

party and file affidavit of service within four weeks after Summer vacation. Till date there has been no compliance of this order. Heard learned advocates for the State.

I do not find any reason why the Investigating Officer should not submit final report in the case in ten years' time. The order dated 16.05.2011 is, therefore, vacated and the revisional application is dismissed for default of the petitioner. Let a copy of this order be sent to the Court of Learned Chief Metropolitan Magistrate, Calcutta for information and necessary action.
