AGP Mr. Pannalal Bandopadhyay ...for the State The petitioner is aggrieved by non-consideration of the petitioner's application for grant of permit to ply autorikshaw on the route Chandannagore Railway Station to Nasibpur Railway Station. The petitioner draws the attention of this Court to a copy of the form appended at pages 16 and 17 of the writ petition (annexure - P1) and submits that the petitioner had submitted this form before the Regional Transport Authority along with requisite fees paid on January 15, 2025 and that despite several months having been passed since such deposit of fees, the petitioner's application has still not been disposed of. On a query from the Court as to the date of the application, (since the copy of the petitioner's application appended to the writ petition does not carry any date), it was submitted that the original application that has been filed before the Regional Transport Authority has been appropriately dated and that in any event the fees that is

to accompany such application has been paid on January 15, 2025 as would be evinced from the receipt therefor at page 18 of the writ petition (annexure P2).

Having heard the learned advocates appearing for the respective parties and having considered the materials on record, this Court feels that justice would be subserved if this writ petition is disposed of by directing the Regional Transport Authority to consider and dispose of the petitioner's application for permit to ply auto-rikshaw as appended at pages 16 and 17 of the writ petition accompanied by the requisite fees (copy of receipt whereof is appended at page 18 of the writ petition), within a period of eight weeks from the date of communication of this order strictly in accordance with law upon giving an opportunity of hearing to the petitioner.

The respondent No. 2, i.e. the Regional Transport Authority shall dispose of the petitioner's application by passing a reasoned order within the aforesaid timeframe and shall communicate such order to the writ petitioner within one week from the date of passing thereof. With the aforesaid observations, WPA 8549 of 2025 stands disposed of.
