Learned Advocate for the petitioners does not press the application for anticipatory bail on behalf of the petitioner no.1, who is the father-in-law.
The application is dismissed insofar as the petitioner no.1 is concerned.
The allegation is of pouring kerosene oil on the victim and setting her on fire. The victim succumbed to severe burn injury after seven days. The petitioner nos.2, 3 and 4 are the mother-in-law, brother-in-law and his wife respectively. The petitioners say that there was a delay of seven days in filing the complaint. The allegations are of general nature.
The husband of the victim has been granted bail by the learned Trial Court. Their prayer for anticipatory bail should be allowed. We have seen the material in the case diary including statements of witnesses and the injury report. Given the nature of allegations prima facie implicating these petitioners and the serious nature of injury suffered by the victim to which she succumbed subsequently and considering the fact that these petitioners did not cooperate with the investigation and also charge sheet is yet to be filed, we are not inclined to entertain the petitioners' prayer for anticipatory bail. C.R.M. No.3321 of 2021 is, accordingly, dismissed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. (Bivas Pattanayak, J.)
