Akadoshi Manna@Ekadoshi Manna v. State Of West Bengal

2023-05-02Hon'Ble Justice Siddhartha Roy Chowdhury2 pages

02.5.2023 SB Ct. No.236 CRR 1273 of 2011 In the matter of : Akadoshi Manna @ Ekadoshi Manna Mr. Prabir Kumar Mitra Ms. S. Ghosh ... for the petitioner Mr. P. Bhattacharyya Mr. M.F.A. Begg.

... for the State Heard Mr. Mitra, learned counsel representing the petitioner, who with all fairness submitted that the petitioner is not in a position to move because of palsy as informed by his son. It is further submitted that WBSEDCL informed the jurisdictional P.S. that the petitioner made the company suffered loss of revenue to the tune of Rs.1,42,523.80 as assessed provisionally but the said contention is far from being correct. However, I do not consider it a fit case to invoke the provision of Section 482 of Cr.P.C.

The revisional application stands dismissed.

Considering the physical condition of the petitioner, learned Trial Court is requested to dispense with his personal appearance if prayed for on behalf of the accused person. Liberty is given to the petitioner to agitate all points before the learned Trial Court.

Let a copy of the order be sent to the learned Trial Court for information and necessary action.
