The petitioner's application for transfer has been refused by the school by application of the 10% Rule.

It is submitted that three teachers have been transferred with the school's no objection in the year 2021.

In view of the amended Rules of 2021, the petitioner now remains the only applicant for transfer.

In those circumstances, the petitioner shall apply afresh for transfer and the same shall be forwarded with an appropriate 'NOC' by the school to the D.I.

The Commissioner of School Education shall, immediately take steps to appoint sufficient number of teachers in the said school in accordance with the provisions of the School Service Commission Act and/or any other relevant statute.

With the aforesaid observations, the writ petition shall stand disposed of.

There shall be no order as to costs.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
