Petitioner prays for sanction of family pension being widow daughter as father of the petitioner who was a retired teacher superannuated on 31st January, 1992 and died on 12th March, 2017. Mother of the petitioner predeceased father on 17th March, 2005. In support of claim of the petitioner for sanction of family pension legal heir certificate dated 30th January, 2025 issued by the competent authority is relied upon which is at page 17 of the writ petition. On query being posed to the learned advocate relating to income certificate it is submitted that same is to be produced before the District Inspector of Schools (PE), Jhargram being respondent no.4 at the time of consideration of prayer of the petitioner for sanction of family pension State respondents are represented by learned

advocates.

Having considered the case made out on behalf of the petitioner, the writ petition stands disposed of directing respondent no.4 to decide the claim of the petitioner seeking sanction of family pension being widow daughter in accordance with law by twelve weeks from the date of communication of this order after granting opportunity of hearing to the petitioner or her representative.

Petitioner shall be at liberty to produce income certificate at the time of consideration of her claim before the respondent no.4.

Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
