IN THE HIGH COURT AT CALCUTTA

Item No.2 CRIMINAL REVISIONAL JURISDICTION Ct.No.34 dc.

C.R.R. 1220 of 2012 (Via Video Conference) Sk. Aksed @ Sk. Aksed Ali & Anr.

versus The State of West Bengal & Ors.

In Re: An Application under Section 482 of the Code of Criminal Procedure, 1973.

The present revisional application was preferred against the order dated 10.02.2012 passed by learned Sub-Divisional Magistrate, Katwa in connection with M.P. Case No. 106 of 2012 arising out of an application under Section 133 of the Code of Criminal Procedure.

Records reflect that the order dated 10.02.2012 only restricted itself in respect of reports being called for from the Officer-in-Charge, Mongalkote Police Station and the B.L.&L.R.O., Mongalkote. The present revisional application appeared on 12.06.2012 and 03.10.2012. No interim order was passed restraining the proceedings before the learned Sub-Divisional Magistrate.

Having regard to the fact that the initial order was only restricted to reports being called for from the statutory authorities, I am of the view that at this belated stage, no interference is called for in respect of the proceedings, as this Court has not been apprised regarding the present stage of the proceedings before the learned Executive Magistrate. Accordingly, CRR 1220 of 2012 is dismissed.

All pending applications, if any, are consequently disposed of.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court. (Tirthankar Ghosh, J.)
