Record of this revisional application reflects that the proclamation so issued has already been executed by the police authorities and the next date has been fixed on 3rd May, 2024 for filing report in respect of the attachment order.
Mr. Majumder, learned advocate appearing for the petitioner undertakes that the petitioner was under the impression in the post-COVID scenario that the learned lawyer appearing would inform him regarding the dates. However, there has been a mis-communication. Having regard to the fact that the case is of the year 2007 and the warrant of arrest was issued after more than 14-15 years an opportunity should be granted to the petitioner.
If the learned Magistrate on perusal of the records finds that the petitioner was earlier on bail he will allow the petitioner to continue on the same bail, however a fresh bond must be furnished by way of a local surety which would be the title deed of a property within the jurisdiction of the learned ACJM, Haldia.
Pursuant to the surrender of the present petitioner, the learned court would recall the proclamation and warrant of arrest, which was earlier issued.
This order will remain in force till 4th May, 2024. If the petitioner do not appear or surrender in that case the learned trial court/Magistrate would revive his earlier order relating to attachment of the property on the next working day.
With the aforesaid observations, the revisional application being CRR 1362 of 2024 is disposed of.
