Achintya Kumar Ghosh v. Shrimati Moumita Ghosh (Bhowmick)
22.07.2021 Item no.16 Ct. No.34 CHC C.R.R. No.1222 of 2012 (Via Video Conference) In Re: An application under Section 482 read with Section 401 of the Code of Criminal Procedure, 1973.
AND In the matter of:- Achintya Kumar Ghosh ... petitioner The present petitioner is aggrieved by the order dated 30th January, 2012, passed by the learned Sessions Judge, Balurghat, District- Dakshin Dinajpur, in Criminal Revision No.14 of 2011. The subject-matter of the grievance of the present petitioner who happens to be the husband is the maintenance awarded by the learned Sessions Judge to the wife which was refused by the learned Chief Judicial Magistrate, Balurghat in M. R. Case No.18 of 2009.
Having regard to the reasons so assigned by the learned Sessions Judge in awarding a sum of Rs.3,000/-, as maintenance to the opposite party no.2/wife, I am of the view that same was on the basis of cogent materials available before the learned revisional court and on proper appreciation of the evidence as such no interference is called for.
Thus, C.R.R.1222 of 2012 is dismissed.
Pending application, if any, is consequently disposed of. Interim order, if any, is hereby vacated.
All parties shall act in terms of copy of this order downloaded from the official website of this Court.
