This revisional application filed under Section 482 of the Code of Criminal Procedure with a prayer for quashing of proceedings in G.R. Case No.805 of 2011 pending before Learned Additional Chief Judicial Magistrate, Barrackpore in connection with Jagatddal Police Station Case No.139 of 2011 under Section 409 of the Indian Penal Code. This is the second consecutive date the matter is fixed up before this Court for hearing but none appears for the petitioners. I find nobody is representing the State today. No Case Diary is produced. Considered.

The revisional application is dismissed for default. Interim order dated 12.05.2011 restraining the investigating authority to submit report without leave of the Court is vacated. Let a copy of this order be sent to Learned Additional Chief Judicial Magistrate Barrackpore for information and to proceed further with the matter expeditiously.
