Petitioner complains that information which was furnished with the Officer-in-Charge Lalgola Police Station dated 07.02.2024 has not been acted upon.

The subject matter of the said case relates to a cheque which was misplaced and the same was not investigated after being informed to the police authorities.

Learned advocate appearing for the state submits that there is a dispute and difference between the petitioner and the private respondents and as such proceedings under section 107 Cr.P.C. has been initiated.

Learned advocate for the private respondents submits that because of circumventing the provisions of Negotiable Instruments Act, the present proceedings have been initiated.

Petitioner prays that his life and liberty is at stake.

In view of the aforesaid police authorities have already taken steps by drawing proceedings under section 107 of the Code of Criminal Procedure. Accordingly I direct that since the information has been lodged and if a proceeding under section 138 of the Negotiable Instruments Act is initiated, in that case the petitioner will be able to produce the documents before the jurisdictional court at the appropriate stage.

With the aforesaid observations WPA 9252 of 2024 is disposed of.
