Rina Mondal (Biswas) v. State Of West Bengal
(AD) 06.05.2022 C.R.M. (DB) 1223 of 2022 Court No.29 (Rejected) In Re: - An application for bail under Section 439 of the Code of Criminal Procedure in connection with Ashoknagar P.S. Case No.781 dated 31.10.2020 under Sections 302/201/203/34 of the Indian Penal Code.
And In the matter of: Rina Mondal (Biswas) ....petitioner.
Mr. Yunus Mondal Mr. Pronojit Roy ...for the petitioner.
Ms. Zareen N. Khan Mr. Ashok Das ... for the State.
Petitioner renews the prayer for bail.
Learned Advocate appearing for petitioner refers to a statement recorded under Section 161 of the Code of Criminal Procedure. He submits that the petitioner is not implicated in the offence. The petitioner is in custody for 551 days. The police submitted charge sheet. Another co-accused was granted bail.
Learned Advocate appearing for the State submits that the other co-accuseds are not standing on the same footing as that of the petitioner. She refers to the materials in the case diary. She submits that the body of the victim was recovered from the septic tank of the house belonging to the husband of
the petitioner. The petitioner was present at the locale. The petitioner, her husband and the victim were last seen together. There is hardly any material change in circumstances subsequent to the earlier order of rejection dated March 10, 2022 rejecting the prayer for bail.
In such circumstances, we are unable to grant bail to the petitioner.
Accordingly, the prayer for bail of the petitioner is rejected.
C.R.M. (DB) 1223 of 2022 is dismissed.
