Heard learned counsels for the parties.
The petitioner is in custody for about 45 days. Learned counsel for the petitioner submits that the petitioner is innocent and has no nexus whatsoever with the alleged offence. He is a man of the locality and only identified the victim, as asked by the alleged miscreants. He was also not a party to the offence.
Learned counsel for the State opposes the prayer. It appears from the statement of the victim recorded under Section 161 of the Code of Criminal Procedure that the petitioner crossed the victim in a scooty and identified him before the alleged miscreants.
The material available in the case diary prima facie suggests involvement of the petitioner in the alleged offence. Investigation is at a nascent stage.
Considering the material on record, the prayer for bail is rejected at this stage.
The application for bail is thus disposed of. Case diary be returned.
