11.04.2023 tkm/ct 28 C.R.M. (DB) 1436 of 2023 sl no.63 In Re : An application for bail under section 439 of the Code of Criminal Procedure in connection with Asansol PS case no. 3 of 2012 dated 14.1.2012 under sections 302/120B IPC read with section 27 of the Arms Act And In Re : Mahendra Mishra ........ petitioner Mr. F Rahman Ms. D Roy ...... for the petitioner Mr. M Sur Mr. A Manna ...... for the State Petitioner is in custody for eight years. He prays for bail on the ground of inordinate delay in trial.
Learned lawyer for the State opposes the bail prayer and submits 46 witnesses have been examined and remaining witnesses would be examined in the course of next schedule. We have considered the materials on record. There are ample materials implicating the petitioner in the crime. Trial has substantially progressed.
Under such circumstances, we are not inclined to grant bail to the petitioner at this stage.
Accordingly, prayer for bail is rejected.
Trial court is requested to conclude examination of the prosecution witnesses positively in the course of next schedule. Petitioner shall co-operate with the trial court in that regard. (Ajay Kumar Gupta, J.) (Joymalya Bagchi, J.)
