C.R.M. (NDPS) 461 OF 2025 In Re : An application for bail under Section 483of the Bhartiya Nagarik Suraksha Sanhita, 2023 in connection with Kartimpur Police Station Case No. 129 of 2024 dated 29.06.2024 under Sections 20(b)(ii)(c) of the NDPS Act.

And In the matter of : Dipankar Nayek .... Petitioner Ms. Jharna Biswas .... For the petitioner Ms. Rituparna Ghosh, Mr. Parven Anam ... for the State 150 kg. ganja was allegedly recovered from the vehicle when the present petitioner was found as driver of said vehicle. Petitioner submits that he is in custody for ten months and though charge sheet has been submitted but nobody knows when the trial will conclude and as such he may be released on bail on any terms and conditions.

Learned counsel appearing on behalf of the State opposed the bail prayer contending that the petitioner being the driver of the vehicle was in conscious possession of the narcotic substances and trial is going to be started shortly. Having considered the facts and circumstances of this case and materials available in the Case Diary and that prima facie it appears that petitioner was in conscious possession of

the narcotic substances the rigor of Section 37 of the NDPS Act attracts in the present context against the petitioner. The prayer for bail made by the petitioner stands rejected. However, the Trial Court is requested to take initiative for early disposal of the case within shortest possible period. CRM (NDPS) 461 of 2025 stands disposed of.

Urgent photostat certified copy of this order, duly applied for, be given to the parties upon compliance of all usual requisite formalities.
