Mr. Mukherjee, learned senior advocate appearing for the petitioner submits that the petitioner has already surrendered on 28th August, 2020 and the learned Magistrate has been pleased to impose the conditions as was earlier directed in the order passed on 25th August, 2020 in CRM 5515 of 2020.
As the petitioner has already surrendered before the learned Magistrate, this court is of the opinion that the order dated 25th August, 2020 which relates to an order under Section 438 of the Code of Criminal Procedure has come to an end and the
petitioner would be at liberty to take out an application for relaxation of the condition of bail, if so advised, before the learned Magistrate.
With the aforesaid observations, CRAN 2 of 2020 in CRM 5515 of 2020 is disposed of.
