Ms Sarbari Das The present revisional application has been preferred challenging the proceedings being Complaint Case No.7394 of 2012 pending before the learned Judicial Magistrate, 2nd Court, Alipore under Sections 403/406 of the Indian Penal Code. The subject matter of the revisional application relates to illegal withholding of a sum of Rs.1,72,896/-, which according to the complainant, was misappropriated by the accused persons in conspiracy with each other.

The petitioners approached this Court immediately on the process being issued.

Having regard to the fact that the complainant has financially suffered, I am of the opinion that the complainant must be allowed to adduce her evidence before charge. The further issues raised in the revisional application relate to question of facts and, as such, the same cannot be interfered by this Court. Accordingly, CRR 744 of 2013 is dismissed.

Pending application, if any, is consequently disposed of. Interim order, if any, is hereby vacated.
