19.04.2023 sdas rejected C.R.M. (NDPS) No. 710 of 2023 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with NCB Crime No. 18/NCB/KOL/2018 dated 07.04.2018 under Sections 22(c )/29 of the NDPS Act.

And In Re : Abdul Kalam ..... petitioner Mr. Sourav Paul ... for the petitioner Mr. Arun Kumar Maiti (Mohanty) Mr. Subrata Santra ... for the NCB Learned Counsel for the petitioner submits he is in custody for 480 days. He prays for bail.

Learned Counsel for the NCB opposes the prayer for bail and submits trial has substantially progressed. Four out of six witnesses have been examined.

We have considered the materials on record. There are ample materials implicating the petitioner in transportation of narcotics i.e. 850 bottles of Phensedyl Syrup. In view of the aforesaid circumstances and as trial has substantially progressed, we are not inclined to grant bail to the petitioner.

The application for bail is, thus, rejected.

Trial court is directed to expedite the trial and conclude the same at an early date without granting unnecessary adjournment to either of the parties.
