Mrs. Monisha Sharma .....For the State The revisional application was preferred challenging the proceedings arising out of Sessions Case No.08 of 2021 corresponding to Amherst Street Police Station Case No.175 of 2020 dated 24.07.2020 under Sections 417/ 376 of the Indian Penal Code.

The petitioner approached this Court at a stage when it was pending for appointment of the learned Public Prosecutor before the learned Sessions Court. The documents so enclosed incorporate F.I.R. and the charge-sheet. None of the documents referred to by the Investigating Agency under Section 207 of the Code of Criminal Procedure particularly relating to the statement of the witnesses and/or any other expert report has been enclosed.

As none appears on behalf of the State, Mrs. Manisha Sharma, learned advocate who ordinarily represents on behalf of the State is directed to represent the case on behalf of the State. Her appointment may be regularized by the concerned authorities. The records of the revisional application reflect that till date the revisional application has not been admitted.

Having regard to the time frame which has passed in the meantime, I am of the view that the petitioner is not interested to pursue the revisional application. The subject-matter for which the present proceedings have been challenged do not contain the necessary documents for consideration, I am of the view that this is not a fit case for interference by this Court.

Accordingly, C.R.R. 1142 of 2021 is dismissed. Pending applications, if any, are consequently disposed of. All parties are directed to act on the server copy of this order downloaded from the official website of this Hon'ble Court. (Tirthankar Ghosh, J.)
