The grievance of the petitioner is directed against a final order of assessment dated 28 January 2026. It is submitted on behalf of the petitioner that there has been delay in filing of the statutory appeal and the petitioner prays for condonation of time in filing such appeal.

On behalf of the respondent WBSEDCL it is submitted that the petitioner is involved in repeated instances of theft of electricity. It is also submitted that in view of the statutory embargo under section 127 of the Electricity Act 2003 there is no scope for extending the prescribed period of limitation.

In view of the available statutory appeal mechanism, WPA 8953 of 2026 stands dismissed.

Liberty is granted to the WBSEDCL to take all coercive steps in accordance with law if so advised.
