Ms. Jharna Biswas ...for the Petitioner In this application, the petitioner has prayed for a direction upon the court below for expeditious disposal of G.R. case no. 677 of 2023, presently pending before learned Judicial Magistrate, 5th Court, Barrackpore.

Being aggrieved by the long pendency of the proceeding, learned counsel for the petitioner submits that the FIR for the said proceeding was lodged on 23rd January, 2023 and after completion of investigation, the charge-sheet was submitted on 1st March, 2023. Since then, the court below has not yet conducted the charge hearing and the matter is unnecessarily getting dragged on due to adjournment petitions filed by the accused person one after another.

Learned counsel for the petitioner also prayed for preponing the date of hearing, as the next date for charge hearing has been fixed on 19th September, 2026. Having heard learned counsel for the petitioner, it appears that the prayer made by the petitioner is innocuous and if it is allowed in terms of the prayer made therein, the opposite parties will have no cause to prejudice

and as such, the service of copy of application upon the opposite parties is hereby dispensed with.

Having considered that fact that the matter is pending since long for charge hearing, I find that the prayer made by the petitioner is justified and is required to be allowed for securing the ends of justice.

In view of above, the instant application being CRR 1629 of 2026 is hereby disposed of with a direction upon the court below to prepone the next date of hearing and to fix a date in the month of June, 2026 for charge hearing and to make best effort to conclude the proceeding preferably within a period of six months from date without granting any unnecessary adjournment to either of the parties.

This order is passed invoking this court's jurisdiction under Section 529 of the BNSS.
