1. Learned counsel appearing for the appellant 03.12.2024 submits that in view of the dismissal of the suit being Title Suit No. 2293 of 2023 dated 29.8.2024, the appeal has become infructuous.

2. It appears from the Order no. 7 dated 29.8.2024 that the suit was dismissed for default for noncompliance of court's order.

3. It has been submitted that the suit has not been restored as yet.

4. In view thereof, this appeal has now become infructuous and the same is accordingly dismissed as withdrawn.

5. However, there shall be no order as to costs.

6. Urgent photostat certified copy of this order, if applied for, be given to the parties on usual undertaking.
