Petitioner is aggrieved by the in action of the 13.02.2025 Court No. 35 Item No.9 Rakib police authorities and has prayed before this Court for taking appropriate steps in respect of Nalhati Police Station case no. 409/22 as well as the other FIRs. Petitioner has also filed complaints with the police authorities, particularly the Officer-in-Charge of Naihati Police Station wherein she complained that she was insulted and humiliated and also threatened to withdrawal of the case.

State has submitted a report. Report reflects that there are three cases being Naihati PS Case no. 409/22, Naihati PS Case No. 195/23 and Naihati PS Case No. 75/24.

So far as Naihati PS Case No.409/22 is concerned against the accused, order of attachment has been already issued after declaring him to be proclaimed offender. In respect of Naihati PS Case No. 195/23 the police authorities have submitted charge-

sheet against nine accused persons and the case is pending before the learned Court at Barackpore. So far as the Naihati PS Case no. 75/24 is concerned final report as false has been filed before the jurisdictional Special Court.

Having considered that police authorities have already taken their steps, so far as the criminal case is concerned and the grievance of the petitioner presently is in respect of she being threatened for withdrawal of the case, particularly, Naihati PS Case No.409/22.

Petitioner is granted liberty to approach learned Magistrate or the learned Trial Court in seisin of the matter for necessary protection under the Witness Protection Scheme, 2018. Learned Magistrate would pass appropriate orders under the Scheme keeping in mind the locus of the present petitioner. With the aforesaid observations WPA 9275 of 2024 is disposed of.

Report so submitted by the State be kept with the record.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
