And In the matter of:- Abdul Ansari @ Abdullah Asari ... Petitioner Ms. Busra Khatun .. for the petitioner Mr. S. S. Imam, Mr. Subrata Roy ..for the State Learned advocate for the petitioner submits that the petitioner is innocent of the charges and he has been falsely implicated in the case of his brother who is a principal accused. Learned advocate for the petitioner further submits that the principal accused namely, Jahangir has already been arrested. Learned advocate for the State produces the memorandum of evidence and draws attention of this Court to the enclosed statement under Section 164 Cr.P.C. of the victim. We have perused the materials on record including the statement of the victim, wherein we find that serious allegations are against this particular petitioner.
Having considered the materials on record and the nature and complicity of the offence we are not inclined to extend the privilege of anticipatory bail to the present petitioner. Accordingly, prayer for anticipatory bail is rejected. With these observations, CRM 5549 of 2020 and CRAN 1 of 2020 (Old No. CRAN 3901 of 2020) are disposed of. (Samapti Chatterjee, J.)
