The contempt application is not maintainable. This Court does not find that, any direction was passed on the alleged contemnors. The order was upon the Secretary to the Government of West Bengal, Panchayats and Rural Development department to make an enquiry with regard to an incident with regard to settlement of ferry ghat and to take immediate remedial measures. This Court had, prima facie, detected foul play as the bid by the respondent no.9 (successful bidder) had gone up to Rs.1,77,55,000/-, although the base price was Rs.1,62,000/-. Admittedly, such amount was not paid.

The applicant has not been able to establish either any contemptuous act or any flagrant violation of the order of the Court.

Under such circumstances, the contempt application is dismissed. Contempt proceedings are dropped. This dismissal will not preclude the applicant from availing of any other remedy under the law.

Parties are to act on the basis of the server copy of this order.
