23/04/2025 D/L 38 Ct. No.28 S.Kundu C.R.M.(A) 1290 of 2025 Rejected In Re:- An application for anticipatory bail under section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023/under Section 438 of the Code of Criminal Procedure in connection with Chanchal police station case no. 52/2025 dated 15.1.2025 under Sections 85/115(2)/117(2)/110/303(2)/3(5) BNS.

In the matter of: Jahangir Alam ... Petitioner Mr. Musharraf Alam Sk.

...for the petitioner.

Mr. Kausik Biswas Mr. Debarshi Brahma ...for the State.

1. Learned counsel appearing on behalf of the petitioner submits as follows. The petitioner is the father-in-law of the alleged victim. The other in-laws except for the husband were granted anticipatory bail by the Sessions Court. The petitioner also stands on the same footing.

2. Learned counsel appearing on behalf of the State relies on the medical report and the statements of the witnesses including the statement of the victim lady. It appears from the statement that all the accused including the husband made dowry demand and inflicted torture for the same. On the fateful day all the accused started beating up the victim. With their help, the husband tried to strangulate the victim and thereafter kicked the victim at the stomach causing miscarriage. Injury reports and all medical documents support the present case.

3. In view of the incriminating materials available in the case diary, I am not inclined to grant anticipatory bail to the petitioner.

4. Accordingly, the application for anticipatory bail is rejected.

5. Urgent Photostat certified copy of this order, if applied for, be given to the parties upon compliance with requisite formalities.
