Petitioner is aggrieved by the fact that the private respondent nos. 9 to 13 along with others have been involved by way of preparing a fake document and threatening the petitioner.

According to the petitioner that by way of a conspiracy, the record of rights have been changed in respect of the property referred to in the writ petition. Mr.

Banerjee, learned Senior Standing Counsel appearing on behalf of the state submits that prima facie the police authorities hardly found any materials particularly in respect of any cognizable offence for registration of any FIR.

In view of the information advanced to the Officer-in-Charge, Basanti Police Station and the nature of the accusations so made, I grant liberty to

the petitioner to approach the jurisdictional magistrate under section 175(3) of the BNSS.

Learned Magistrate will assess regarding the contents of the accusations which were advanced to the police authorities and thereafter pass necessary directions by exercising his discretion.

With the aforesaid observations WPA 9293 of 2024 is disposed of.
