The investigating officer has submitted that since the investigation is over and the mechanical expert opinion has been collected, he has no objection if the vehicle is returned to the petitioner. Accordingly, petitioner would communicate this order along with the copy of the report to the learned A.C.J.M., Contai, Purba Medinipur/ jurisdictional court. The court in seisin of the matter will impose conditions for releasing the vehicle, as it deems fit and proper. The whole process must be completed within one week from the date of communication of this order by the learned jurisdictional magistrate concerned. With the aforesaid observations, C.R.R. 1285 of 2023 is disposed of. Pending application, if any, is consequently disposed of. All parties are directed to act on the server copy of this order downloaded from the official website of this Hon'ble Court.
