1. Learned counsel appearing for the petitioner submits as follows. The petitioner is the complainant in C.R. Case no. 335 of 2019 under Section 138 of the Negotiable Instruments Act, presently pending before the learned Judicial Magistrate, 1st Class, 4th Court, Serampore, Hooghly. In spite of having the case filed in 2019, till date the proceeding could not be concluded. On several dates one or more of the accused would absent themselves and after some time surrender and obtain bail. This way the accused have delayed the proceeding and the learned Trial Court has not been able to take appropriate steps. The proceeding has remained pending for no fault of the present petitioner.

2. It appears that there is an inordinate delay in conducting the proceeding in a case under Section 138 of the Negotiable Instruments Act.

3. In view of the above and in the interest of justice, the learned Trial Court is directed to conclude the proceeding as expeditiously as possible without granting unnecessary adjournments any of the parties and by taking effective steps for ensuring attendance of the accused and by keeping in mind the statutory stipulations contained in the said Act about the expeditious conclusion of this proceeding.

4. With these observations and directions, the revisional application is disposed of.

5. Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance with requisite formalities.
